Introduction

Welcome to Pawfect Snapshots. These Terms of Service ("Terms") govern your access to and use of the services, features, content, and applications offered by Pawfect Snapshots ("Services"). Please read these Terms carefully before accessing or using the Services. By accessing or using the Services, you agree to be bound by these Terms.

Registration and Account

To access the Services, you may be required to create an account. You agree to provide accurate, complete, and current information during the registration process and to update such information to keep it accurate, complete, and current. You are responsible for maintaining the confidentiality of your account information and for any activities that occur under your account.

User Content and License Grant

By submitting, posting, or displaying content on or through the Services, you grant us a non-exclusive, royalty-free, worldwide license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods for the purpose of training the AI to produce new photos based on the input. We will not post your photos or display them publicly without obtaining your explicit permission to do so. You represent and warrant that you have all rights, power, and authority necessary to grant the rights granted herein to any content that you submit. For content that you have the necessary rights to, you retain all ownership rights, including the AI-generated images based on your pet's photos. You are granted the right to use, distribute, and display the AI-generated images for both personal and commercial purposes, provided you possess the appropriate rights to the original content.

Content Ownership and Responsibility

You represent and warrant that you own or have the necessary permissions to use and authorize the use of your content. You are solely responsible for ensuring that you have the appropriate permission from the pet owner before uploading any pet's photos to the Services.

Prohibited Uses

You agree not to engage in any of the following prohibited activities:

a. Upload or distribute any content that infringes upon any copyright, trademark, or other intellectual property rights of any person or entity;

b. Upload or distribute any content that is unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, or otherwise objectionable;

c. Use the Services for any illegal purpose or in violation of any applicable laws;

d. Attempt to interfere with or compromise the system integrity or security of the Services;

e. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

Violation of Terms

You acknowledge and agree that any violation of the Terms, including the Prohibited Uses, may result in the immediate revocation of your license to use any and all content generated by our Services, including AI-generated images. Upon such violation, you must cease all use of the content and delete any copies of the content within your possession or control. You shall then have no right to use the Services or the content generated from the Services for any purpose.

Should you be found to have engaged in unauthorized use of our Services, or in any way breached the Terms set forth herein, Pawfect Snapshots reserves the right to terminate your right to use the Services and any associated content. This termination will take effect immediately upon your breach of the Terms without the necessity of any notice. If you have been found to redistribute or use AI-generated content from our Services in violation of these Terms, you are required to cease all such activities immediately.

Disclaimer of Warranties and Limitation of Liability

a. The Services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. Pawfect Snapshots expressly disclaims any and all warranties, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

b. Pawfect Snapshots does not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that any information, data, or content obtained through the Services will be accurate, reliable, or complete. You understand and agree that your use of the Services is at your sole risk.

c. In no event shall Pawfect Snapshots be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from your use of the Services or any other claim related in any way to your use of the Services.

Indemnification

You agree to indemnify, defend, and hold harmless Pawfect Snapshots and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

Termination

Pawfect Snapshots may terminate or suspend your access to the Services at any time, with or without cause, with or without notice.
